West Virginia Sick Leave Law
In West Virginia, private employers have the right to define their own sick leave policies, whether paid or unpaid.
However, state employees accrue sick leave at a rate of 1.5 days per month or about 18 days per year. They also get unlimited carryover and can use the leave type for personal or immediate family medical care.
Employees can also use up to 80 hours of leave per year for family sick time, and up to 3 days per occurrence for bereavement. Though policies vary from agency to agency, so check with your department.
West Virginia Paid Time Off (PTO) Law
West Virginia does not mandate private companies to offer paid PTO or vacation days. They can define their own leave policies, especially when it comes to accrual, carryover (“use-it-or-lose-it”), and payout at the time of termination. They must mention these rules in their employee leave handbook. If the employer excludes PTO payout, they are not entitled to payout the unused leave at the time of separation.
Meanwhile, state agencies provide annual leave to public sector workers according to their tenure and departmental policy.
Family and Medical Leave (FMLA, Parental Leave Act)
Federal FMLA applies statewide. All eligible employees, especially those who complete 12 months of service, log in 1,250 hours, and work for an employer with 50+ employees, can take up to 12 weeks of unpaid, job-protected leave per year. They can use the leave type for personal serious health issues, family care, childbirth or adoption, or certain types of military needs.
As per the West Virginia Parental Leave Act (PLA), certain public workers can take up to 12 weeks of unpaid leave after they exhaust all annual and personal leave. They can use the leave type for child birth, adoption, or qualifying family health events.
West Virginia Bereavement Leave
Private employers have no obligation to offer bereavement leave. However, most companies provide 3 to 5 days for immediate family loss, but this is completely optional.
Public employers and educators often provide accrued sick leave for bereavement, which is typically up to 3 days per event. The state’s definition of immediate family includes children, spouses, parents, siblings, in-laws, and others in the house.
West Virginia Domestic Violence Leave

West Virginia State-Specific Leaves
