Leave and Working Hours Policy 2025 : Assam

In Assam, if you run a shop, hotel, or commercial workplace with more than 10 employees, there are specific rules you need to follow. These are laid out in the Assam Shops and Establishments Act, which covers things like working hours and leave. The rules are published officially in the state Gazette.

Assam’s approach considers its own culture and work realities. Full-time employees are usually well-covered. But if someone’s working part-time or on a contract, their benefits often depend on their contract terms or any special state notices.

So, Assam aims to create a fair and inclusive work environment for both public and private sector employees.

Leave Rules

Types of Leave and Entitlements:

Leave Type Entitlement Notes
Earned Leave 1 day per 20 days worked (approx. 12–15 days/year) Accumulates up to 45 days; encashable if refused after 15-day advance notice or upon discharge/retirement.
Casual Leave 8 days/year Credited quarterly; no carry-forward; lapses if unused.
Sick Leave 7 days/year Credited at year’s start; requires medical certificate; lapses if unused.
National & Festival Holidays 8 days/year Includes Republic Day (Jan 26), Independence Day (Aug 15), Gandhi Jayanti (Oct 2), and 5 agreed-upon festivals; paid at regular wages or double wages with substitute leave if worked.
Maternity Leave 26 weeks (182 days) Per Maternity Benefit Act, 1961; for women with <2 surviving children; 6 weeks for miscarriage.
Paternity Leave Not specified May be offered at employer’s discretion; no mandatory provision.

HR Action Tips:

Here are a few tips for you to ensure your seamless leave planning for employees:

  • Plan in advance: Employees should ideally apply for earned leave at least 15 days before they plan to take off. If their leave is declined and their balance crosses 45 days, they’re still eligible for encashment—but only if they followed the notice period.
  • Sick Leave Protocol: When employees take sick leave, ask for a valid medical certificate. It’s a small step that avoids confusion or disputes later, especially during audits.
  • Festival leave clarity: Out of 8 festival holidays, 5 are optional. Settle on those early in the year with your team. This avoids last-minute gaps and respects everyone’s cultural preferences.

HR Action Tips

Here are some action tips to manage work hours efficiently:

  • Shift visibility: Make sure shift schedules and weekly offs are visible and easy to understand—especially if you have rotating or night shifts.
  • Overtime tracking: Employees can’t work more than 125 overtime hours per quarter. Overtime has to be paid double the regular wage—no exceptions. It’s important to track this carefully.
  • Workplace safety regulations: Good lighting, proper ventilation, and cleanliness aren’t just for comfort—they’re required. Regular checks can help you stay compliant and reduce risks.

Additional Provisions

Assam’s leave and working hours policy also lists down certain additional provisions that businesses can’t afford to miss:

  • Women working at night: Generally, women can’t be assigned work between 9:00 PM and 6:00 AM. But if an employer gets an exemption from the state and provides safe transport, restrooms, and other facilities—it may be allowed.
  • Health and hygiene: Employers must ensure the workplace stays clean and safe. This includes proper lighting, ventilation, fire prevention, and regular supervision to prevent accidents.
  • IT and biotech exceptions: Employees in IT, biotechnology, and R&D may be exempt from regular working hours—but only if the state approves.
  • Mandatory record-keeping: Keep registers updated for attendance, leave balances, overtime, and identity details. These must be made available if the Facilitator or inspector asks.
  • Fines and legal risks: Non-compliance with leave or working hour rules may lead to fines or legal action under the Assam Shops and Establishments Act.
  • Employee ID cards: Every worker must be issued an identity card with official details. This can be requested for verification at any time.

Frequently Asked Questions

What happens if someone works on a festival holiday?

They must be paid double wages, and they’re also eligible for a substitute leave. So they don’t lose rest or pay.

How is earned leave calculated?

Employees earn 1 day of leave for every 20 days worked in the previous year, provided they’ve worked at least 240 days. Some absences, like maternity leave, also count toward the total.

Can women work night shifts in Assam?

Only if the employer has official approval from the state and ensures safety measures like transport, restrooms, and anti-harassment protocols. The restricted window is from 9:00 PM to 6:00 AM.

Are weekly holidays compulsory?

Yes. Employees must get at least 24 hours of continuous rest every week. If that’s not possible, compensatory leave should be given within the next two months.

What safety measures are employees expected to follow?

Ensure cleanliness, proper lighting, ventilation, and fire safety. Regular monitoring is expected to avoid accidents or health issues.
