Leave and Working Hours

Leave and Working Hours Policy in India

If you’re running a business across multiple Indian states, you’ve probably discovered that employment laws aren’t as straightforward as you’d hope. What works in Maharashtra might not fly in Karnataka, and the leave policy that keeps your Delhi employees happy could land you in trouble in Tamil Nadu.

Here’s the reality check: India follows a federal model, and the applicable employment laws are usually a combination of both State and Central laws. While the Centre sets the basic framework through codes, the states add their individual provisions with local variations.

But why does knowing these laws actually matter?

A firm’s compliance policy cannot be more generous than the one underlined by the state’s specific Shops and Establishment Policy. While you are entitled to create your own framework or policies for your employees, failing to meet the basic standards will land you in legal hot water.

So, on that note, let’s always stay compliant with the state and central requirements and get started on understanding them better.

What Does This Guide Include?

We have broken down the leave and working hours landscape across all the Indian states and union territories, by focusing on guidelines that actually matters and impact your daily operations:

  • Leave entitlements: How many casual, sick, and earned leaves you must provide to your employees.
  • Working hours: Daily and weekly limits along with the occasional overtime norms.
  • Overtime rules: Overtime wages are to be paid at twice the normal rate.
  • Public vs Private: Different rules for government and public establishments

With that clear, let’s get started with the state-wise leave and working hours policies.

Understanding Different Types of Employee Leaves

Here is a breakdown of the various leave types along with their clear purpose and set of rules governing them:

Casual Leave (CL)

Casual leaves can be defined as “no questions asked” time off. Employees use it to attend to their personal commitments like weddings, or handle family emergencies, or just to take a mental break.

Key features

  • Typically ranges from 10 to 15 days annually
  • Cannot be accumulated or carried forward
  • May require advance notice
  • Not encashable

Sick Leave (SL)

Sick leaves are reserved for health issues, illness, or medical appointments. The exact number of these leaves is dependent on state-specific regulations.

Key features

  • Ranges from 7 to 15 days annually
  • May require medical certificates if extended over a period of time
  • Some states allow unused sick leaves to be carried forward
  • Encashment rules are dependent on state-specific policies

Earned Leave or Privilege Leave

This is the leave you “earn” through your service. The longer you work, the more earned leave you accumulate. It’s considered the most valuable type of leave since it’s almost always encashable.

Key features

  • Standard rate of 1 per 20 working days
  • Can be accumulated up to 30 – 45 days dependent on state regulations
  • Must be encashed upon resignation/retirement

Maternity Leave

Protected under the Maternity Benefit Act, 1961, this applies to all establishments with 10 or more employees. The central law provides the baseline, but states can be more generous.

Key features

  • 26 weeks for first two children
  • 12 weeks for third children onwards
  • Some states offer other additional benefits
  • Paid leave with full salary

Paternity Leave

While not mandatory, many states and progressive companies offer paternity leave and benefits to support new fathers.

Key features

  • Varied widely by state
  • Usually 15 days around childbirth
  • Often unpaid, unless specified by company policies

Festival/Religious Leave

This is highly state-specific, as it depends on individual state-mandated public holidays. Because of India’s diversity what is a working day in one state might be a holiday in another.

Key features:

  • Varies by state and regions
  • Includes optional holiday list to choose from
  • Accommodates religious diversity

Compensatory Off (Comp-Off)

When employees work on weekends, or holidays, they become eligible for compensatory time off instead of overtime payment.

Note

Not all states allow comp offs in lieu of overtime pay. Check with your state’s specific rules before implementing them across your organization.

Special Leaves

These are a few state-specific or industry-specific provisions of leaves:

  • Bereavement leave: Time off for family members’ death.
  • Marriage leave: For employee’s own wedding.
  • Adoption leave: Some states mandate this for adoptive parents.
  • Voting leave: Time off to vote during election time.

Key Differences to Always Keep in Mind

Here are some of the state-specific variations, you’ll come across in the individual pages:

Leave TypeTypical RangeNotable Variations
Casual leave10 -12 daysSome states allow up to 15 days
Sick leave 7 – 15 days Karnataka – 12, Punjab - 7
Earned leave 1 day per 20 worked Accumulation limit – 30 to 45 days
Maternity leave 26 weeks Some state offers additional benefits

Note

For every 20 working days, an employee might add up to 1 day of earned leave (specific rules differ by company and law). The carry-forward rules and accumulation limits vary significantly between states.

Working Hours

Most people assume an India-wide rule of 8-hour day, 48-hour week applies. However, while the base line stands true, its application varies:

  • Standard hours: 8 hours daily, 48 hours weekly with one weekly off
  • Extended hours: Some states allow 9 hours with adequate breaks
  • Shift work: Different rules for continuous process industries
  • Seasonal Variations: Agricultural states have harvest season adjustments

Overtime Rules

While the basic overtime rule is, once you cross the daily hour limit, overtime kicks in at 1.5x or 2x the regular wage rate, these are certain discrepancies:

  • Some states have quarterly overtime limits
  • Overtime calculation methods differ for piece-rate workers
  • Holiday work often attracts double wages
  • Night shift allowances are mandatory

Public vs Private: Two Entirely Different Entities

Government employees and private sector workers often operate under completely different rules, even within the same state.

Government/Public Sector Norms

For public sector employees:

  • More generous leave allowances
  • Stricter work hour adherence
  • Festival leaves for regional celebrations
  • Pension and gratuity benefits

Private Sector Norms

For private sector employees:

  • Must meet state-mandated rules or offer better benefits
  • More flexibility in working arrangements
  • Market-driven additional perks and benefits

To be more aligned with government mandated compliances, many successful companies create policies that exceed state minimums across all locations. This simplifies administration and creates a consistent employee experience.

How to Handle Multi-State Operations?

Running a business across multiple Indian states doesn’t have to be a compliance nightmare. Here are few strategies to smartly handle them:

For HR Teams

  • Map out your operational states and their specific requirements
  • Create a compliance matrix showing minimum requirements vs. your current policy
  • Set up quarterly reviews for law changes
  • Maintain state-wise documentation for audits

For Business Owners

  • Factor compliance costs into expansion planning
  • Consider uniform policies that exceed all state minimums
  • Budget for potential penalty costs of non-compliance
  • Review policies when acquiring companies in new states

For Payroll Teams

  • Use state-specific overtime calculation methods
  • Ensure leave accrual system matches state rules
  • Maintain detailed records for labor inspections
  • Set up alerts for quarterly overtime limit monitoring

Thus, state labor laws are ever-changing, and constant monitoring of annual policy reviews, minimum wage revisions, industry-specific exemptions, and public holidays. One smart tip to ensure compliance is to set up Google alerts to catch up with the latest compliance updates.

Keep work hours compliant across locations

Automate Leave management

Got questions?

Can I have one uniform leave policy across all Indian states?

Yes, but it must meet or exceed the basic state requirements, like if one state offers 10 sick leaves and other mandates 12 sick leaves, your uniform policy should offer 12 sick leaves.

What happens when an employee works in multiple states?

Generally, the state where the employee is primarily stationed governs their employment terms. However, for employees who travel frequently, you might need to consider the most employee-friendly interpretation to avoid disputes.

Are startups exempt from these state-specific requirements?

No, company size or establishment year doesn’t exempt you from labor law compliance. However, the number of employees you have usually governs this policy.

How do I handle overtime for employees working beyond state boundaries?

You will need to track working hours by state policies and apply their respective overtime rules.

Can unused leaves always be encashed?

Encashment rules vary by state and leave type. If employment ends, workers must be compensated for earned leave in most states, but casual and sick leave encashment policies differ significantly.
