Mississippi Leave Laws Mandates
When it comes to leave laws, whether for a sick day or to care for an ailing family member, Mississippi follows the federal rules, especially the Family and Medical Leave Act (FMLA). The state allows private sector companies to draft their own employee leave policies. Mississippi Sick Leave Law

Major medical leave covers personal and family illness. But it requires employees to use personal leave days first, especially in the case of chronic or long-term absences certified by a doctor.
Public employees also have access to unlimited carryovers for personal and major medical leave, with some paid out at the time of separation.
Mississippi Paid Time Off (PTO) Law
Similar to sick leave, the state has no laws mandating private employers to provide paid vacation or PTO leave. It allows them to draft policies regarding accruals, rollovers, and “use-it-or-lose-it” provisions as they deem fit.
Public sector employees can use personal leave for any purpose, and it accrues monthly. But it formula to calculate these leaves is based on years of service.
Family and Medical Leave (FMLA)
All eligible employees, whether public or private, working for an organization with 50+ workers, and who log 1,250 hours per year, receive protection under the federal FMLA. They get up to 12 weeks of unpaid, job-protected leave for qualifying reasons, including medical, child bonding, or family care reasons.
Employers must continue to offer health benefits and restore the employee to their original or an equivalent position after leave.
Mississippi Bereavement Leave
Private employers have no state boundation to offer bereavement leave. They can determine eligibility and duration as per company laws. State employees may use up to 3 days of sick leave to mourn the death of an immediate family member. However, they may be asked to furnish necessary documents.
Mississippi Domestic Violence Leave
Mississippi has no rules mandating that both public and private companies offer domestic violence leave. FMLA may apply if domestic violence results in a pre-defined health condition.

State-Specific Leaves
- Personal/Major Medical Leave: Public employees accrue personal leave according to their tenure, which they can use for personal and family needs. Sick leave is not mandated for private employees.
- Paid Parental Leave (Public Employees): As of January 2026, state employees who are primary caregivers will receive 8 weeks and secondary caregivers will get 2 weeks of paid parental leave after childbirth or adoption. These will be fully paid and concurrent with FMLA.
- Jury Duty: All employees get job protection for serving on a jury. Employers must allow time off for jury duty.
- Military Leave: State employees are entitled to receive paid leave for serving in the military. They also have job reinstatement rights under the federal USERRA.
